SOCIAL STATE AND THE RIGHT TO WORK UNDER THE CONSTITUTION OF THE REPUBLIC OF TURKEY (1982)

Abstract
As it is known, one of the basic characteristics of the social state is its intervention in social and economic life. The right to work is an example of this intervention, especially with its obligations imposed on states. As a social right, it also serves the aims of the social state, like “protection of human dignity.” There is a close relation between the social state and the right to work. Thus the Constitution of the Republic of Turkey (1982) proclaims the principle of social state with article 2 and with article 49, it guarantees the right to work for everyone. However it is observed that, the relation between these two is not adequately addressed in the decisions of Turkish Constitutional Court.
Bilindiği gibi, sosyal devletin başlıca özelliklerinden biri sosyal ve ekonomik hayata müdahale etmesidir. Çalışma hakkı da özellikle devlete getirdiği yükümlülüklerle, bu müdahalenin örneklerinden birini oluşturmaktadır. Ayrıca sosyal hak niteliğindeki bu hak, “insan onurunun korunması” örneğinde olduğu gibi, sosyal devletin amaçlarına hizmet etmektedir. Sosyal devlet ile çalışma hakkı arasında yakın bir ilişki vardır. Nitekim 1982 Anayasası da 2. maddeyle sosyal devlet ilkesini benimsemiş, 49. maddeyle de çalışma hakkını herkes için güvence altına almıştır. Anayasa Mahkemesi kararlarında ise bu ikisi arasındaki ilişkinin yeterince ele alınmadığı gözlemlenmektedir.
